This Services Agreement (“Agreement”) is entered into on November 6, 2024 between ______ (“The Client”) and John D’Amico Entertainment (“JDE”). This Agreement provides for JOHN D’AMICO (“The Performer”) to perform at an event taking place on _______ at _______ at ____________________ (“the Event”). In consideration of the mutual covenants contained in this Agreement, the parties agree as follows:

1. Payment

a. Performance Fee. The fee for the provision of Music Services contemplated in Section 3(a) is the fee listed at checkout.

b. Non-refundable Deposit. The amount of the Deposit is 50% of the Performance Fee. JDE shall communicate to Client when the Performer has been secured. The Deposit shall be due no later than 10 days after the Performer is secured.

c. Effect of the Deposit. Client acknowledges that the Deposit is non-refundable and represents Client’s assent to the terms of this Agreement.

d. Balance of Performance Fee. The balance of the Performance Fee shall be due no later than the day of the Event.

2. Payment Methods

All amounts under this Agreement shall be made payable to John D’Amico Entertainment by cash, check, Square, or Venmo (@john-dAmico-8). All checks shall be made out to “John D’Amico Entertainment” and mailed to 61 Maple Street, Unit G, Canton, MA 02021.

3. Provisions of Services and Equipment

a. Performance. JDE shall provide Music Services during the Event which includes: PLAYING LIVE MUSIC, SINGING, ETC.

b. Song Selection. The setlist will be written by the Performer according to the preferences of the Client and will include any songs on JDE’s song list. JDE may purchase additional sheet music for songs not on the song list in value up to 10% of the total Performance fee, not to exceed $300.00.

c. Equipment. JDE shall provide all equipment required for performance.

d. Break Periods. The Performer may take several break periods of flexible duration based on the needs of the Event.
